U Visa (U Nonimmigrant Status)

We commonly see clients here at Amigos Immigration who qualify for a U Visa (U Nonimmigrant Status). It is intended to help people who are victims of serious crimes while in the U.S., who suffered mental or physical abuse as a result of the crime. The applicant must be willing to assist law enforcement and government officials to investigate or prosecute the crime.

You may qualify for a U Visa if you were a victim of a crime including:

  • Felonious assault

  • Sexual assault

  • Rape

  • Domestic violence

There are many other qualifying criminal activities cited by USCIS.

U Visa status is valid for four years, and extensions are available in certain circumstances. You may also be eligible to apply for a Green Card (adjustment of status/permanent residence) if you meet certain requirements.

Along with your U visa application, certain members of your family may qualify for their own derivative U visa. All family members apply together and, if the principal applicant is approved, their applications will be considered.
